Following the Rules

In recognition of these dangers, the Texas Parks & Wildlife Department has made special rules for operators of Jet Ski personal water crafts, in addition to the rules that all motorboats must follow. Failure to follow these rules—or, in the case of a rental agency, knowing failure to enforce them—is a form of negligence that could leave operators and/or businesses legally liable for any accident that results. Manufacturers of PWC may also be liable for Jet Ski accidents stemming from flaws in the PWC themselves, including failure to include a brake or reverse as well as manufacturing defects and failure to warn about serious risks.
